These Terms govern your booking for, and attendance at, the Event. It is your responsibility to review these Terms prior to making a booking. By making a booking for the Event, you agree to be bound by these Terms. We reserve the right to amend these Terms at any time and will provide the most recent version on our website at https://www.retreatalittle.com (Website).
You may make a booking in accordance with the Booking Process and for the Price. In making a booking, you agree that:
- your booking at the Event is confirmed once you have received an email notification and receipt from us;
- entry to the Event will be permitted on presentation of your booking confirmation;
- the Price covers all of the Inclusions, any further requirements not set out under the Inclusions may be at an additional cost;
- you must pay the Price (including GST) for your booking and any credit card surcharge or administration fees as specified on our Website and in accordance with the Payment Terms;
- payments will be made through a third party payment processor, such as Stripe, Apple, Android or Square, or by any other payment method set out on our Website. The payment method you choose may be subject to additional terms and conditions imposed by the applicable third party payment processor;
- booking prices may be subject to change and we will use best endeavours to inform you of any changes; and
- if any payments are over 5 business days late from its due date, you will forfeit your place at the Event and any proportion of the Price you have paid prior to the due date.
Refunds, Credits and Transfers
Bookings are non-transferable and we do not provide a refund for change of mind.
Subject to the below, all bookings are final and no exchange, credit or refund will be given. For avoidance of doubt, no refund or credit will be provided for change of mind or if you did not enjoy the Event, arrive late, or are unable to attend the Event.
Refunds may be provided for your cancellation only if we have been able to fill your spot with somebody else and only at our sole and absolute discretion.
Event Cancellation or Postponement
If the Event is cancelled, rescheduled or postponed, then this clause will apply.
If the Event is postponed (including due to the COVID-19 pandemic), you may notify us in writing no later than 14 days after the originally scheduled Event Date to obtain credit for the booking price to put towards another one of our Events that occurs within 12 months of the originally scheduled date of the postponed Event (Credit Request). If we do not receive a Credit Request, your booking will be automatically transferred to the new date for the postponed Event.
If the Event is cancelled for any reason, including due to the Covid-19 Pandemic, you will receive credit for the booking price to put towards another one of our events that occurs within 12 months of the date of the cancelled Event. We reserve the right to issue refunds at our sole and absolute discretion only.
We will use best endeavours to notify you of any cancellations, rescheduling or postponements of the Event with reasonable prior notice through email, however depending on the circumstances from time to time we may have to make a last-minute decision. We will do our best to communicate the circumstances with you at all times. You acknowledge that it is your responsibility to ascertain whether an Event has been cancelled, rescheduled or postponed.
Any refund or credit issued to you under this clause will be your sole remedy for a postponement or cancellation of the Event and we will have no further liability to you in respect of any cancellation, rescheduling or postponement of an Event for any reason. If you require travel insurance or other insurance, you are responsible for obtaining this, noting that the Event booking does not cover any such insurance.
During the Event, you agree that:
you will behave in an appropriate manner and act decently and with respect to all other participants at the Event;
cameras, audio and video recorders may not be permitted at certain Events and you must comply with any requests in this regard; and
you will comply with our reasonable directions and advice for all matters relating to the Event.
We reserve the right to refuse entry or require you to leave the Event if your behaviour is deemed unacceptable at our absolute discretion.
Photography and Recording
We may take photographs (Photographs) and recordings (Recordings) at the Event. You agree that:
accepting these Terms means you consent to being filmed or photographed by us (or our representatives) and for us to use your name, likeness, image and/ or voice in such photographs or films for the purposes of promoting our events, services and products;
no remuneration is payable to you for our use of such Photographs and Recordings;
you release us from any infringement or violation of personal and or property rights of any sort based on our use of such Photographs or Recordings;
we are not obligated to use any Photographs or Recordings; and
you may request for us not to use a particular Photograph or Recording, however we are under no obligation to do so and any consent to your request will be at our absolute discretion.
You warrant that you do not have any pre-existing medical conditions or disabilities (Medical Issues) that will affect your ability to attend and participate the Event. If you have any Medical Issues, you should consult with a health professional as to whether the Event is appropriate for you prior to your booking. You are solely responsible for ensuring that you are medically capable of attending the Event. You acknowledge and agree that medical services may be limited at our Events and the Location. You authorise us to take any such action as necessary for the provision of medical services at your cost, including the attendance of any doctor, nurse, paramedic or ambulance officer. You must reimburse us these costs within 7 days of demand.
Notwithstanding anything else in these Terms we are not liable for any injury, death, damage or loss caused or due to any Medical Issues that you experience at the Event.
You agree to attend our Events on the following basis:
we do not guarantee any outcomes with respect to the results of our Events, including any improvement in general health and wellbeing, reduction in stress and/ or feeling restored mentally and spiritually;
our Events often take place at remote or regional areas and while we do our best to operate our Events as advertised, we reserve the right to amend, vary or cancel certain parts of our Event where it is necessary due to climate, weather conditions or other circumstances, at our sole discretion;
we may advertise or offer a specific supplier (including a yoga or Pilates instructor) (Supplier) for our Event from time to time, however due to unexpected circumstances or circumstances beyond our control, the Supplier may be unavailable for the Event. If this occurs we will use best endeavours to replace the Supplier with someone of similar quality and experience and you acknowledge that we are not liable to you for the unavailability of any Suppliers;
while we try our best to advertise our Events and Location as accurately as possible, some of the images and/ or videos used for such advertisement have been provided by third parties and may differ to what is actually seen or experienced, and we are not liable for any differences in this regard; and
as we offer a wide range of food and drinks at the Event, if you have any allergies or dietary restrictions it is your sole responsibility to manage your own food consumption and we are not liable for any injury, death, damage or loss in this regard.
Limitation of Liability
To the maximum extent permitted by law, we are not responsible for any loss, damage, expense or liability suffered by you or any other third party and caused or alleged to be caused directly or indirectly as a result of attending the Event.
Subject to the below, any condition or warranty which would otherwise be implied in these Terms are excluded.
Our liability for breach of a guarantee conferred by the Australian Consumer Law is limited, in the case of services, to any one of the following as determined by us:
the supplying of the services again; or
the payment of the cost of having the services supplied again.
If there is a problem with the Event or our services caused by a breach of these Terms by us (Omission), and you have notified us within 24 hours, then to the maximum extent permitted by law our liability arising from, or in connection with, the Omission will be limited to the face value of the booking purchased by you.
These Terms contain the entire understanding and agreement between us in respect of its subject matter.
If any provision of these Terms are held to be void, invalid, illegal or unenforceable, that provision is to be read down as narrowly as necessary to allow it to be valid or enforceable, failing which, that provision (or that part of that provision) will be severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in this Terms.
These Terms are governed by the laws of South Australia.
